These Terms govern your use of garagesalebiz.com, every operator site hosted on a subdomain of it, and the GarageSaleBiz platform. They apply whether you are a visitor, a shopper looking at a sale, or an operator.

If you have purchased a territory, the Operator Agreement also applies and takes precedence over these Terms wherever the two differ.

The short version

1. Who we are

GarageSaleBiz is operated by Kingdom Creatives LLC ("we", "us", "our"), a limited liability company. Our contact address for everything, including legal notices, is info@kingdom-creatives.com.

2. Who may use the platform

Anyone may browse this site and any operator site. To purchase a territory you must be at least 18, able to enter a binding contract, and located in the United States.

You may not use the platform if we have previously terminated your account, or if you are barred from doing so under applicable law or sanctions.

3. What the platform is

GarageSaleBiz is software and training for people who run garage and moving sales as a service for homeowners. We provide operators with a website, a dashboard, document templates, a sign maker, and a course.

We are a software provider, not a sale operator. We do not run sales, price items, handle anyone's money, or take possession of anyone's property. Every sale advertised on the platform is run by an independent operator who is solely responsible for it.

We are not a marketplace, an auction site, or a payment intermediary for sales. No transaction between a shopper and an operator passes through us.

4. If you are a shopper

This section is for you if you found an operator's site while looking for a sale near you.

Your dealings are entirely with the operator, not with us. We do not own, inspect, price, describe, or sell any of the items you see listed. We have not verified their condition, their authenticity, their safety, or that the operator has the right to sell them.

  • Listings can be out of date. Items sell during a sale and may be gone before you arrive. Prices shown are asking prices and may be discounted or negotiated on the day.
  • Everything is sold as-is. Used goods carry no warranty from us and generally none from the operator or the homeowner either.
  • Dates, times, and addresses are supplied by the operator. Sales can be postponed or cancelled, including for weather.
  • Take normal care. A sale takes place at a private residence. Watch your footing, do not let children wander, and check anything mechanical or electrical before you buy it.
  • Any dispute about an item, a price, or a purchase is between you and the operator. If you cannot resolve it, you may tell us at the address in section 18 — we will pass it on and it informs whether we keep hosting that operator, but we cannot arbitrate it, reverse a payment, or compel a refund.

We collect nothing from you when you browse an operator site beyond what the Privacy Policy describes, and you do not need an account.

5. Accounts and security

Operators need an account. You are responsible for keeping your password secure, for everything done under your account, and for telling us promptly at info@kingdom-creatives.com if you think it has been compromised.

Do not share your credentials, and do not create an account using someone else's identity or a false one. One account per operator business.

6. Purchases and fees

An operator territory costs $249, paid once. There is no monthly fee, no annual fee, no renewal, and no recurring charge of any kind. We do not keep your payment method after checkout.

Payment is processed by Stripe. We never see or store your card details. Your use of Stripe's checkout is also subject to Stripe's own terms.

Prices are in US dollars and exclude any tax that may apply. Prices for new territories may change at any time; a change never applies to a purchase already completed and can never create a charge on an existing operator.

Refunds are governed by section 10 of the Operator Agreement: 14 days, subject to the two conditions stated there.

7. Territory exclusivity

Each territory covers three cities and is exclusive within this platform: we will not sell a GarageSaleBiz territory to another operator in those cities while the account is active.

It does not mean an operator is the only person who may run sales in those cities. Anyone may hold their own sale and other companies may operate there. Section 3 of the Operator Agreement sets out exactly what exclusivity does and does not cover, and it is worth reading before purchasing.

Availability is checked when cities are selected and again when payment completes. If two purchases collide on the same city, the earlier completion takes it and the other buyer is offered a different city, a full refund, or a refund plus first refusal — their choice.

8. Operator sites and content

Operators publish their own content: sale details, item listings, descriptions, and photographs. That content is theirs, not ours, and we do not pre-review it. Operators own it and grant us only the limited licence needed to host and display it.

Operators are responsible for having the right to publish what they publish, including permission to photograph and advertise a client's possessions and to publish the address of a client's property.

We may remove content or take an operator site offline without notice if we believe it is unlawful, infringing, fraudulent, or exposes someone to harm. We are not obliged to monitor content, and doing so in one instance does not oblige us to in another.

If you believe content on an operator site infringes your copyright, or was published without the property owner's permission, tell us at info@kingdom-creatives.com with enough detail to identify it and we will act promptly.

9. Acceptable use

You may not:

  • Break the law, or help anyone else to.
  • Attempt to access another operator's data, another account, or any part of our systems you have not been granted access to.
  • Probe, scan, or test the security of the platform without our written permission.
  • Scrape, crawl, or bulk-extract data, or use automated means to create accounts or submit forms.
  • Upload malware, or anything designed to interfere with the platform.
  • Impersonate anyone, or misrepresent your relationship with us.
  • Resell, redistribute, or republish the course or the document templates.
  • Use the platform to advertise anything unlawful, or any item you do not have the right to sell.
  • Make any earnings claim or guarantee of results on our behalf.

We report credible threats to safety and clear criminal conduct to the appropriate authorities.

10. Our intellectual property

The GarageSaleBiz name, the platform software, the course, the templates, and the design of this site are owned by Kingdom Creatives LLC and protected by copyright and other laws. Purchasing a territory grants the licence described in section 4 of the Operator Agreement and nothing more — it does not transfer ownership of anything.

Operator business names and logos belong to those operators.

11. Third-party services

The platform depends on services we do not control:

  • Stripe — payment processing.
  • Supabase — database, authentication, and file storage.
  • Vercel — website hosting.
  • Brevo — transactional email.
  • Google Fonts — typefaces.

Each has its own terms and privacy practices. We are not responsible for their acts or omissions, and an outage at one of them may make the platform temporarily unavailable. What each one receives is set out in the Privacy Policy.

Operator sites may link to third-party sites, including mapping services. We do not control or endorse those.

12. No professional advice

Nothing on this platform is legal, tax, accounting, insurance, or financial advice. That includes the course, the client agreement templates, and anything we say in an email.

Permit requirements, sign ordinances, business licensing, sales tax, and the employee-versus-contractor question vary by state and by city. The client agreement templates have not been reviewed for any particular jurisdiction and must be reviewed by an attorney licensed where you operate before you rely on them.

13. Disclaimers

The platform is provided "as is" and "as available", without warranty of any kind, express or implied, to the fullest extent the law allows. We do not warrant that it will be uninterrupted, secure, or error-free, or that any defect will be corrected.

We make no representation or promise about income, revenue, profit, number of clients, or business success of any kind. Operators may make no money and may lose money. Results depend on individual effort, skill, market, and circumstance. Any figure or example anywhere reflects one person's situation and is not typical, expected, or promised.

We make no warranty about any item listed on any operator site, or about any sale taking place, being held on the advertised date, or proceeding as described.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

14. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunity, lost data, or loss of goodwill.

Our total liability to an operator is limited to the amount they paid us, being $249. Our total liability to anyone who has paid us nothing — including any shopper — is limited to $100.

We are specifically not liable for: any transaction between a shopper and an operator; the condition, safety, authenticity, or value of any item; injury or property damage at any sale; an operator's conduct, honesty, or compliance with the law; or a sale being cancelled, postponed, or different from its listing.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence.

15. Suspension and termination

We may suspend or terminate access for breach of these Terms or the Operator Agreement. For operators, section 11 of the Operator Agreement governs: for anything short of unlawful conduct or fraud we contact you first and give you the chance to put it right, and we keep your data for 90 days afterwards so it can be restored or exported.

You may stop using the platform at any time. Because there is no recurring charge, there is nothing to cancel to avoid being billed.

16. Disputes and governing law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws rules.

Contact us first. Before starting any formal proceeding, email info@kingdom-creatives.com describing the problem and what you would like done, and allow 30 days to resolve it.

If that does not resolve it, the courts located in Idaho have exclusive jurisdiction and both parties consent to venue there. Either party may bring a qualifying claim in small claims court.

17. Changes to these Terms

We may update these Terms. The effective date at the top changes when we do, and we will email operators at least 30 days before any material change takes effect.

A change cannot create a recurring charge for an existing operator, cannot reduce the exclusivity of a territory already purchased, and cannot retroactively alter what an operator agreed to at purchase — the version each operator accepted is recorded and kept.

Continuing to use the platform after a change takes effect means you accept the updated Terms.
